NetJets Labor Day Sweepstakes (the “Sweepstakes”) starts on Friday, August 30, 2019 when the @NetJets profile message announces the contest (approximately 10:00 a.m. Eastern Time (“ET”)) and ends on Monday, September 2 at 11:00 a.m. ET (“Entry Period”).
ELIGIBILITY: Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older. Employees of NetJets Services, Inc. (“NetJets”) and its respective parent, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. Void where prohibited by law. Sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of NetJets, which are binding and final on matters relating to this Sweepstakes. Sweepstakes is subject to all applicable federal, state, and local laws.
DEFINITIONS:
For purposes of the Sweepstakes, the following definitions apply:
“NetJets Aircraft” means aircraft with tail number ending in “QS” registered to NetJets with the Federal Aviation Administration, limited to the aircraft types listed on the netjets.com webpage under “Our Programs & Aircraft.”
“Revenue Flight” means a flight that moves a NetJets Owner from one airport to another airport on a NetJets Aircraft.
TO ENTER: During the Entry Period, there is one (1) way to enter:
1. INSTAGRAM: To enter, visit the NetJets Instagram profile at @NetJets. Guess the type of NetJets Aircraft to fly the most Revenue Flights landing during the Entry Period (“Top Labor Day NetJets Aircraft”) to be entered into the Sweepstakes.
Each Instagram profile that correctly guesses the Top Labor Day NetJets Aircraft on the first try during the Entry Period will be entered into the drawing to win the prize. All entries must be received during the Entry Period to be considered. Entries generated by script, macro, or other automated means are void. Limit one (1) entry per Instagram profile. If a person submits more than one entry from an Instagram profile, then only the first entry received from the Instagram profile will be considered. If no one guesses the correct Top Labor Day NetJets Aircraft, then the NetJets Aircraft type with the next most Revenue Flights during the relevant time period will be selected until a winner is determined. If you choose to post or share comments on Instagram using your mobile phone, standard data rates may apply. See your wireless service provider for pricing plan details and capabilities. An Instagram account is required for entry. An Instagram account can be opened for free at www.instagram.com or by downloading the Instagram application onto your smartphone from the appropriate app store.
REQUIREMENTS OF ENTRIES:
Entry may not contain, as determined by NetJets in its sole discretion, any content that:
DRAWING: Each entry that correctly identifies the Top Labor Day NetJets Aircraft on the first guess to the NetJets Instagram profile will be entered into a random drawing, with a single potential winner selected and identified on Tuesday, September 3, 2019. Odds of winning depend on the number of eligible entries received.
WINNER NOTIFICATION: The potential winner will be notified via direct message on Instagram. The potential winner must then follow the instructions provided by NetJets to contact NetJets with his/her full name, age, and all required contact information within five (5) days of date of notification. The potential winner may be required to execute and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release within seven (7) days of date of issuance. If such documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, NetJets is unable to contact the potential winner, or the potential winner is not in compliance with these Official Rules, prize will be forfeited and, at NetJets’ discretion, an alternate winner selected. If the potential winner is an eligible minor in his/her jurisdiction of residence, prize may be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winner set forth herein.
Prize: The winner will receive a package of NetJets store products with a total actual retail value of approximately $190.00.
Prize is awarded “as is” with no warranty or guarantee, either express or implied by NetJets. Winners may not substitute, assign, or transfer prize or redeem prize for cash, but NetJets reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. Winners are responsible for all applicable federal, state, and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. General Conditions: NetJets and its respective parents, affiliates, subsidiaries, advertising and promotion agencies, and Instagram, and all of their respective officers, directors, employees, representatives, and agents (collectively, “Released Parties”) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, garbled, or damaged entries or email; or for lost, interrupted, or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing, or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors, or difficulties that may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website or who are in violation of these Official Rules, as solely determined by NetJets, will be disqualified and all associated entries will be void. Should any portion of the Sweepstakes be, in NetJets’ sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, or other causes that, in the sole opinion of the NetJets, corrupt or impair the administration, security, fairness or proper play, or submission of entries, NetJets reserves the right at its sole discretion to suspend, modify, or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by NetJets. Entrants, by participating, agree that Released Parties will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses, or damages of any kind, including death, to persons or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of any prize or participation in this Sweepstakes. Winner, by acceptance of prize, except where legally prohibited, grants permission for NetJets and its designees to use his/her name, address (city and state), photograph, voice, and/or other likeness and prize information for advertising, trade, and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. In the event of a dispute regarding entries received from multiple users having the same email account, the authorized subscriber of the email account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), online service provider, or other organization responsible for assigning email addresses.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, NETJETS WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

ARBITRATION: Except where prohibited by law, as a condition of participating in this Sweepstakes, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement, and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. - is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Entries;
- defames, misrepresents, or contains disparaging remarks about other people or companies;
- contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, email addresses, or street addresses;
- contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies, or other media), without permission;
- contains materials embodying the names, likenesses, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
